Overlapping Jurisdiction: One Property, One Value

One of the more confusing issues that a property owner faces concerning Texas property tax law is in attempting to understand how a single piece of property can have more than one fair market value. However, in situations where a single property is appraised by more than one appraisal district due to overlapping jurisdiction, such discrepancies have often been the case.

In the last regular legislative session, the Tax Code was amended to try to resolve this confusion, requiring appraisal districts to put the same value on the same property. But this is not the first time that the Legislature has attempted the "One Property, One Value" rule. Will it work this time?

Proposed Legislation in the Special Session

The Texas Legislature is meeting in special session to address issues involving school financing. There have been numerous proposals regarding funding that could impact property taxes, many of which would involve constitutional amendments.

Several bills have been introduced during the special session that could, if enacted into law, directly affect property tax issues. In an effort to keep those interested in Texas property tax matters advised, GPD is providing a summary of the bills introduced that could impact property tax. The summary is being updated regularly as new bills are introduced.

Upcoming deadlines

May 15
Extended deadline to file business personal property rendition forms if extension requested

May 31
Deadline to file protest of appraised value

May 31
Third of four installments due for senior or disabled homestead taxpayers

Important Note
Because May 31 is a legal holiday (Memorial Day) in 2004, the deadline above is pushed to June 1, but only if the protest is filed in person at the appraisal district office. The deadline for mailing a protest is May 29.
